TIME TO GET READY FOR FY2022 H-1B CAP REGISTRATION AND PETITION FILINGS

While USCIS is yet to release a formal guidance for the upcoming H-1B Cap Petition filings, employers who wish to sponsor foreign nationals for the FY2022 annual quota (or cap) should anticipate registrations to open on March 1^st, 2021.

Note that because of the regulatory freeze announced by the White House on January 20^th, 2021, USCIS’ final rule creating a wage-based selection process for H-1B registrations  will NOT go into effect until March 21^st, 2021. White House memorandum suggests that the implementation of the final rule may be delayed even further by  opening a 30-day comment period to allow interested parties to provide comments about issues of fact, law, and policy raised by the rule.

Important Dates: H-1B Registration Process Timeline for FY2022

• March 1^st: H-1B registration period opens at noon ET.
• March 20^th: H-1B registration period closes at noon ET.
• March 31^st : Date by which USCIS intends to notify selected registrants.
• April 1^st: The earliest date that FY 2022 H-1B cap-subject petitions may be filed.

Si bien USCIS aún no ha publicado una guía formal para las próximas presentaciones de Petición  H-1B, los empleadores que deseen patrocinar a ciudadanos extranjeros para la cuota anual (o límite) del año fiscal 2022 deben anticipar que las inscripciones se abrirán el 1 de marzo del 2021.

El memorando de la Casa Blanca sugiere que la implementación de la regla final puede retrasarse aún más al abrir un período de comentarios de 30 días para permitir que las partes interesadas brinden comentarios sobre cuestiones , derecho y política planteadas por la regla.
