Biden to Restart MPP “Remain in Mexico” Policy

The Biden Administration will restart the controversial Migrant Protection Protocols (MPP) program as soon as next week. MPP, which was started by former President Trump, requires most individuals seeking asylum at the border to wait in Mexico while their asylum claim is processed in the U.S. It has also been called the “Remain in Mexico” policy.
Shortly after he was elected, President Biden ended MPP. In August, a federal judge ruled that the MPP program must be reinstated because it was not properly rescinded by the Biden administration. This week, the government of Mexico agreed to restart the MPP after weeks of negotiations between the Mexican and U.S. governments.
According to a report from Reuters, “Any migrant from the Western Hemisphere could be placed in the reworked MPP program.” This includes individuals who are fleeing from Central and South American countries like Honduras, Guatemala, El Salvador, Nicaragua, Venezuela, and Brazil. It also could include a large number of Haitians who come to the U.S.-Mexico border. Under the program, any individual who is afraid of being persecuted in Mexico will not be forced into the MPP program. Instead, they will be allowed to stay in the U.S. while they wait for their asylum claim to be processed in the U.S.
The MPP program has been criticized because it often sends individuals fleeing violence back to Mexico with few resources, including housing, food, and legal access. There were hundreds of reports of murders, kidnappings, rapes, and other attacks. Individuals in MPP were often targets of human traffickers near the border. The Biden administration still intends to end the MPP program permanently and fight the judge’s order in court. However, as long as the judge’s order remains in place, the MPP program will move forward.
