New DACA Applications Blocked by Texas Judge

On Friday afternoon, a judge in Texas ruled that the DACA program was illegal. Despite the fact that DACA applicants do not have any formal legal status, the judge ruled that only Congress can create a program like DACA because it allows undocumented individuals to remain in the U.S. and apply for work permits.
The judge placed an injunction on all first-time DACA applications. This means that anyone who filed for DACA for the first time and has not received a decision will have their cases put on hold. The judge said first-time applicants can still file applications. However, USCIS cannot approve any first-time DACA applications, whether they are already pending or filed after July 16, 2021. There is no word on whether individual who already filed first-time applications will receive a refund if the program is stopped.
Right now, the judge’s order does not affect individuals who already have DACA. These individuals will keep their current DACA and can even file applications to renew their DACA. The court battle for DACA likely will continue for several months and maybe years. If appellate courts agree with the judge in Texas, the DACA program could be phased out over time.
President Biden and numerous businesses and advocacy groups have condemned the judge’s ruling. The president already announced his administration is going to appeal the judge’s ruling to a circuit appellate court. The president’s administration also will continue to work on regulations to strengthen the DACA program. However, the future of the DACA individuals may depend more on Congress. According to several news reports, Democrats in the U.S. Senate are considering creating a pathway to citizenship for individuals with DACA and TPS as well as other groups of immigrants. The immigration reform could become part of a larger reconciliation package, which requires only 51 votes in Senate (50 Democrats and vice president Kamala Harris).
