USCIS TO SUSPEND BIOMETRICS FOR H-4, L-2 AND CERTAIN E NONIMMIGRANTS

In recognition of the significant backlog and hardship posed by the extended time USCIS has been taking to adjudicate both the Form I-539 and related Form I-765, Application for Employment Authorization, the agency has decided to suspend biometrics for H-4, L-2 and certain E nonimmigrants for 24 months.
On May 3, 2021, USCIS’ Acting Associate Director of Service Center Operations (SCOPS) Connie L. Nolan submitted a declaration in Edakunni v. Mayorkas stating, among other things, that USCIS is finalizing a policy that will temporarily suspend biometrics submission requirements for individuals filing Form I-539 to request an extension of stay in or change of status to H-4, L-2 and certain E nonimmigrants due to the extended processing times resulting from limited Application Support Center (ASC) capacity due to ongoing COVID-19 health and safety protocols.
Per USCIS’ declaration, the current number of Form I-539s for H-4 and L-2 spouses in the backlog is approximately 123,000. The current number of Form I-765s for H-4 and L-2 spouses in the backlog is approximately 57,500.
Expected to begin on Monday, May 17, 2021, the new policy suspending biometrics submission requirements for the H-4, L-2 and E nonimmigrants is intended to be in effect for 24 months, and is intended to automatically expire after May 17, 2023, subject to affirmative extension or revocation by the USCIS Director.
Applications where the principal nonimmigrant’s Form I- 129, Petition for a Nonimmigrant Worker, has been approved will become adjudication- ready on that date.
The suspension of biometrics is intended to apply only to H-4, L-2 and E-1, E-2 and E-3 categories of Form I-539 applications that are pending as of the effective date of the policy and have not yet received a biometric services appointment notice, and new applications received by USCIS after the effective date of the policy.
Note that USCIS will retain discretion on a case-by-case basis to require biometrics, and any applicant may be scheduled for an ASC appointment to submit biometrics for identity verification and other screening purposes.
Recently, USCIS has undertaken a variety of adjudicative actions to aggressively address the backlog. Service centers currently have approximately 120 officers adjudicating Form I- 539 for the H-4 and L-2 classifications with another 33 officers scheduled for training in May 2021. In the past 60 days, service centers completed approximately 25,000 related to H-4 and L-2 spouses.

En reconocimiento de la acumulación significativa y las dificultades planteadas por el tiempo extendido que USCIS ha estado tomando para adjudicar tanto el Formulario I-539 como el Formulario I-765 , Solicitud de Autorización de Empleo, la agencia ha decidido suspender las huellas digitales para H-4, L -2 y ciertos no inmigrantes E durante 24 meses.
El 3 de mayo del 2021, la directora adjunta interina de operaciones del centro de servicios (SCOPS) de USCIS, Connie L. Nolan, presentó una declaración en Edakunni v. Mayorkas que indica, entre otras cosas, que USCIS está finalizando una política que suspenderá temporalmente los requisitos de presentación de huellas digitales para personas que presenten el Formulario I-539 para solicitar una extensión de estadía o un cambio de estatus H-4, L-2 y ciertos no inmigrantes E debido al tiempo que extienden los procesamientos que resultan de la capacidad limitada del Centro de Soporte de Solicitudes (ASC) debido a COVID- 19 y los protocolos de seguridad y salud.

La suspensión de huellas digitales está destinada a aplicarse solo a las categorías H-4, L-2 y E-1, E-2 y E-3 de las solicitudes del Formulario I-539 que están pendientes durante la fecha de vigencia de la política y no han recibió un aviso de cita para tomarse las huellas digitales y las nuevas solicitudes que el USCIS recibió después de la fecha de vigencia de la política.
Tenga en cuenta que USCIS conservará la discreción, caso por caso, para requerir huellas digitales, y cualquier solicitante puede ser programado para una cita con el ASC para enviar huellas digitales para verificación de identidad y otros fines de revisión.
